Summarized

Based on the information delivered and gathered at by the GWIS agents and what we all can read at the org forums I, Magyar Khan, came to this conclusion:

"Tosa is guilty for misusing his Admin-org powers to ban members from the org to whom he held personal grudges."

People like Kocmoc (Clan Wolves), FearNC (Clan Fearfull Ways) and me (Clan Wolves) were involved in the thread "Units tire too fast". So were others, one who has to be mentioned is Puzz3D aka MizuYuuki (Clan Takiyama). After many constructive posts from all sides the discussion came actually to an end, sadly accompagnied with a yellow chip for Kocmoc and an official warning for FearNC.
As with many constructive posts they are written for death-mans-ears as the developers won't really listen unless something is bigtime wrong with the game. But suddenly one of the posts (page 7) by FearNC contained this phrase:

"almost every member of every beta team since stw.. and there has been one consisitent report from all of them. you are overbearing and manipulitive, and in general, will not listen to others or there ideas if they stray too far from your truth. the time has come for an open beta, like simbol says filled with every kind of player. if 6 of the 9 testers were wolves or fears you would be saying the same thing"

For the weakhearted this may sound rude, for the ones involved it was not really new info and should not led to where it did. FearNC was being banned. Although the "Units tire to fast" thread headed on. FearNC send out another clanmember to start a new topic, "NC's response to Tosa". A post that came straight from his heart and fueled by anger. It trickered all sort of responses, and ended by Tosa banning Kocmoc, Monsta and me.

Tosas grudge over these members found root in Teragate. There are obvious more little reasons for the banning. Tosa has trouble wielding his admin powers, and misused them in this case.

Advices for the future of the .org
- all involved who are banned yet should be unbanned.
- the .org staff must state publicly that the banning was a bridge to far, powers were misused to improve mainly the staffs own pleasure.
- the banning-procedure should be improved and structured in a fair and public way.
- Tosas power has to be limited to what he does best, keeping the .org in the air.

Every reaction on this verdict is welcomed at this chill-out forum in the Total Wars Animal Forum. Rant and rave as you please... You won't get banned.

The "evidence"
The "evidence" is all readable at the www.totalwar.org forums although Puzz3D deleted some parts. Deleting (read: severe editing) is not the brightest thing to do in such cases but it may be caused by a certain level of dissapointment and some feeling he was not free of some "guilt" at all.

Its good fact-finding if you can hear both sides, I was convinced Tosa and Puzz3D would not want to be heared. Nevertheless I don't think it would chance the verdicts outcome.

The role of FearNC...
Puzz3D is referred by FearNC as "overbearing and manipulitive". This was the start of the banning. FearNC is a blunt person who strongly believe in a free world. Somethimes he mixes things up causing trouble (on purpose or by accident) but in general he has his heart on the right place. He should not be banned in the first place. His reaction was out of line but you can not expect from someone not to kick back as he has been slapped a few times too much.

The role of Kocmoc...
Kocmocs role is limited as well. He is dissapointed about some aspects of the game. Using a small vocubalary he tries to convince others for his case. Which ain't easy since he sees some things faster than other. Most of the time others are not ready to "see" his points.
Kocmoc was early chipped as a warning, but his posts were never out of line. His interaction with Puzz3D can be unlucky, but it is not intented to be rude or abusive. Kocmoc should not be banned.

The role of Monsta...
Monstas role is limited as he wasn't really posting in the Units tire too fast thread in the first place. He did post in the "Nc's Response to Tosa" thread. Only Tosa managed to find something in his posts that justifies the banning of Monsta. Monsta should clearly not have been banned. Monsta is a person driven by standing up to injustice of all sorts.

The role of Puzz3D...
Puzz3D is referred by FearNC as "overbearing and manipulative" which ain't far beyond the truth. Puzz3D helps a lot of people and chooses his -native- language well to express the things that suits his ideas best. He is limited in his interactions with people to look things from other points of view. His attitude can be described as haughty (informal: hoity-toity). There are many ways to be arrogant. I am sure that Puzz3D is a good person but there are moments that he puts himself above the crowd in a camouflaged nasty way, something he likes to blame others for as well.
Puzz3D can not be blamed for his role in this as he is being himself and his posts aint rude in a barbaric sense of way. Unlucky for him he is the oil on someone elses fire.

The role of the forum mods...
As ever the forum mods play a role in this, the have an high "stand by your admin" attitude. This is good in certain situations, but not in all cases. The ability of self-reflection amongst the complete staff is low and should be improved for the orgs. benefit. Its close to fun to read their posts where they made at leasts the same mistakes as where they accused others on.

The role of Tera...
As a miracle Tera managed to get involved in this case as well by writing a post of mixed ideas, a smart combo of truths and lies in such a way only Tera seems to accomplish. It took a while before his posts were closed, Tosa reply to it with a content thats fair enuf.

As before KenchiTera managed to get Clan Kenchikuka involved as well by naming KenchiAndy in his post. KenchiAndy was quoted: "they were poking fun more than attacking
but they are still cocks who need to be tought a lesson...". KenchiTera either misses the refinement to keep his clan out of trouble or it was his plain intention to draw his clan in it. Somethimes I feel ashamed for being a very old ex-member of Kenchikuka. Kenchikukas role in this is close to none, as Tera is in his category second to none.

I won't comment on it any further cuz Tera is not worth this attention. In a way I must admire the nerve of Tera to post what he posted. He is smart enuf to know that it wouldn't be without punishment although he did enuf asscreeping and perhaps he relied to much on his clanbuddies of which one is a org-mod himself. It failed he is banned as well.

The role of Tosa, and beyond
His grudge over certain pillars of the community caused by Teragate and their blunt & direct behaviour is bigger than his wisdom and advices he got to stay out such debates. There is no need to write a full epistal about his mentally state or social behaviour. Tosa is certainly a nice person and in real life not a danger for civilisation. He has just given to much power which he can't wield correctly. But after all noone is perfect.

Tosas role goes beyond this case. As he and the .org-staff as a whole did a great job. But there are failures as well. The lack of self-correction is one, another major one is that their combined effort never succeeded to lift the multiplayer part from the barren pastures it now lives on. The multiplayer aspect of the TW series deserves a fertile envirronment and everything within a -very popular- fansite's power shall be used to achieve the maximum possible.

The role of myself...
People can read the whole "Units tire too fast" thread (if it is still in the air) and I would be impressed if someones would find any negative remark which would result in breaking the rules. I admit I directed some scentences towards Tosa where I stated that Tosa should stick to what he does best, keep the .org in the air and leave the banning to the moderators. In a way perhaps against the rules, but the truth had to be said. Regular readers of the org forums must admit I stayed mild on the "Units tire too fast" thread and tried to keep the thread constructive as in my belief the units do tire too fast. But if people keep bugging me like Tosa did by the way he handled the communication about the avatars-title and the unjustified banning of FearNC and the chipping of Kocmoc than a voice from the WMT (Wolves Mobile Throne) have to be raised. Some readers call this whining or the wolvies howling but Freud will learn you, people whine cuz they are not being heard. The MP-voice is not being heard or supported.

To answer Tosas question: "Magyar Khan Is arrogance the only reason for the repeated problems?" No Tosa it's the whole community not being able to give the MP-part of the game the place it deserves. And you and your buddies reserved attitude towards many aspects to improve this game in respective of the developers plays a major role in it. Arrogance comes in many shapes, my version is blunt, clearly visible for others. You are part of a Hoity Toity boyz club yourself, which show a more refined form of arrogance.

Summarised, as I found myself partly guilty in the mess around Teragate I can not find any fact that I am guilty in Tosagate.
